TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern the use of the AWAY Travel Advisors LLC website and the travel planning, advisory, booking, concierge, and related services provided by AWAY Travel Advisors LLC, doing business as AWAY Travel (“AWAY,” “we,” “us,” or “our”).

By requesting travel planning services, authorizing a reservation, submitting payment information, making payment toward a booking, or otherwise utilizing our services, you acknowledge that you have read, understood, and agree to these Terms on behalf of yourself and all travelers included in your reservation.

1. AWAY TRAVEL AND OUR ROLE

AWAY is a professional travel advisor that assists clients with researching, planning, arranging, and facilitating travel services provided by independent third-party suppliers.

Depending upon the itinerary, these suppliers may include airlines, cruise lines, hotels and resorts, tour operators, destination management companies, transportation providers, rental car companies, excursion and activity operators, travel insurance providers, and other travel-related businesses (“Travel Suppliers”).

Unless expressly stated otherwise, AWAY does not own, operate, manage, or control Travel Suppliers or the accommodations, transportation, facilities, equipment, activities, or other services they provide.

AWAY acts as an intermediary between the traveler and applicable Travel Suppliers. Each Travel Supplier maintains its own terms and conditions, payment requirements, cancellation and change policies, passenger contracts, and limitations of liability. Such terms apply to the traveler’s reservation in addition to these Terms.

2. HOST AGENCY AND SELLER OF TRAVEL

AWAY Travel Advisors LLC operates as an independent travel advisor affiliated with OASIS Travel Network (“OASIS”).

AWAY files annually with the Florida Department of Agriculture and Consumer Services (“FDACS”) as an independent sales agent and represents OASIS Travel Network, which maintains the applicable Florida Seller of Travel registration.

AWAY utilizes OASIS as its host agency and may utilize OASIS supplier credentials, accreditation, payment and commission processing systems, technology, and other host-agency services in connection with travel arrangements made on behalf of AWAY clients.

Accordingly, certain supplier reservations, invoices, payment authorizations, confirmations, or other travel documentation may identify OASIS Travel Network in addition to or instead of AWAY Travel Advisors LLC.

Additional Seller of Travel disclosures may be provided where required by the laws applicable to a particular transaction.

3. PROFESSIONAL PLANNING AND CONCIERGE SERVICES

In addition to facilitating travel reservations, AWAY may provide professional consultation, itinerary design, research, destination guidance, concierge planning, reservation management, and other advisory services.

Certain services may be subject to professional planning, consultation, concierge, itinerary design, change, cancellation, or other service fees.

Any applicable professional fee will be disclosed to the client before the fee is charged.

Unless otherwise expressly agreed in writing, professional fees paid directly to AWAY compensate AWAY for professional time, expertise, research, consultation, itinerary development, reservation management, concierge services, or other professional services and are separate from amounts charged by Travel Suppliers for travel arrangements.

Professional fees are generally nonrefundable once the applicable professional services have commenced, except where otherwise required by law or expressly agreed to by AWAY in writing.

4. PRICING, QUOTES AND AVAILABILITY

All travel pricing, availability, promotions, amenities, credits, upgrades, and other offers are subject to availability and may change until a reservation has been confirmed and any required payment has been successfully processed.

A quotation or proposed itinerary does not constitute a confirmed reservation and does not guarantee pricing or availability.

Unless otherwise stated, quotations are based upon the information and travel requirements supplied by the client at the time the quotation is prepared.

Travel Suppliers may change pricing or impose taxes, government fees, resort or destination fees, gratuities, fuel surcharges, or other charges when permitted by applicable law and the supplier’s terms.

AWAY is not responsible for changes in supplier pricing or availability occurring before a reservation is confirmed.

5. RESERVATIONS AND PAYMENTS

The client is responsible for providing accurate payment information and ensuring sufficient funds or available credit for authorized transactions.

By providing payment authorization, the client authorizes AWAY, OASIS, and/or the applicable Travel Supplier to process the authorized amount using the payment method provided.

Payments for travel arrangements may be processed directly by Travel Suppliers or through OASIS or other approved travel-industry payment systems.

A reservation is not considered confirmed until the applicable Travel Supplier has accepted the reservation and any required payment has been successfully processed.

Payment deadlines established by Travel Suppliers are strictly enforced. Failure to provide payment by a required deadline may result in cancellation, loss of space, loss of promotional pricing or amenities, or other penalties imposed by the supplier.

AWAY is not responsible for a reservation that is canceled or otherwise affected because required payment or information was not provided by the client by the applicable deadline.

6. CLIENT RESPONSIBILITY FOR REVIEWING RESERVATIONS

Clients are responsible for carefully reviewing all quotations, proposals, itineraries, invoices, confirmations, tickets, travel documents, and other information provided by AWAY or a Travel Supplier.

Clients must verify, as applicable:

  • Traveler names and spelling;
  • Dates of birth;
  • Travel dates;
  • Flight dates, airports, schedules, and routing;
  • Cruise dates, ships, staterooms, and itineraries;
  • Hotel, resort, and room categories;
  • Tour, activity, and transfer details;
  • Passport and identification information;
  • Pricing;
  • Deposit and final-payment requirements;
  • Cancellation and change policies; and
  • Any other material details of the reservation.

Traveler names must match the traveler’s applicable government-issued identification or passport.

Any discrepancy should be reported to AWAY promptly. The client may be responsible for costs resulting from incorrect information supplied to or approved by AWAY.

7. PASSPORTS, VISAS AND TRAVEL DOCUMENTATION

Each traveler is solely responsible for obtaining and maintaining all documentation necessary for travel, including passports, visas, electronic travel authorizations, identification, parental consent documentation, vaccination or health documentation, and any other documents required by governmental authorities or Travel Suppliers.

International travelers are responsible for ensuring that their passports satisfy the validity requirements of every destination and transit point included in their itinerary.

Entry and exit requirements may vary based upon citizenship, residency, destination, transit location, criminal history, prior travel history, and individual circumstances.

AWAY may provide general information concerning documentation or entry requirements as a courtesy. Such information should be treated as general guidance and may change without notice.

AWAY does not provide legal or immigration advice and cannot guarantee information supplied by governmental authorities, Travel Suppliers, or other third parties.

Final responsibility for satisfying all passport, visa, immigration, customs, entry, exit, and documentation requirements rests with each traveler.

AWAY shall not be responsible for losses resulting from a traveler’s failure to obtain or maintain required documentation or authorization to travel.

8. HEALTH, MEDICAL AND ACCESSIBILITY CONSIDERATIONS

Travelers are responsible for determining whether they are physically and medically capable of participating in their planned travel arrangements.

Clients should advise AWAY of accessibility requirements or other travel-related accommodations that may affect the selection or arrangement of travel services.

AWAY will make reasonable efforts to communicate such requests to Travel Suppliers but cannot guarantee that a supplier, destination, transportation provider, accommodation, venue, or activity can satisfy a particular request.

Travelers should consult appropriate medical professionals regarding health concerns, medications, vaccinations, and fitness for travel.

9. TRAVEL INSURANCE

AWAY strongly recommends that travelers consider appropriate travel insurance.

Depending upon the policy selected, travel insurance may provide coverage for certain circumstances involving trip cancellation or interruption, travel delays, lost or delayed baggage, emergency medical expenses, emergency evacuation, or other covered events.

Insurance benefits, exclusions, limitations, eligibility requirements, and deadlines vary by policy. Travelers are responsible for carefully reviewing applicable policy documents and determining whether the coverage is appropriate for their needs.

If a client declines travel insurance, the client accepts responsibility for losses that might otherwise have been covered by an appropriate insurance policy.

AWAY is not an insurance company and does not determine whether an insurance claim will be covered. Claims and coverage determinations are made by the applicable insurance provider pursuant to the terms of the applicable policy.

10. CHANGES AND CANCELLATIONS

All travel changes and cancellations are subject to the terms and conditions of the applicable Travel Supplier.

Supplier penalties may include deposits becoming nonrefundable, change fees, cancellation penalties, fare differences, loss of promotional pricing or amenities, or forfeiture of some or all amounts paid.

Airline tickets may be nonrefundable and may be subject to fare differences, reissue fees, carrier restrictions, or other conditions.

Cruise lines, tour operators, hotels, resorts, and other Travel Suppliers maintain their own deposit, final-payment, cancellation, and change schedules.

Professional fees charged separately by AWAY are governed by AWAY’s applicable fee terms and may remain nonrefundable regardless of whether a Travel Supplier issues a refund or credit.

Clients should not consider a cancellation or modification completed until written confirmation has been received from AWAY or the applicable Travel Supplier.

11. REFUNDS AND TRAVEL CREDITS

Eligibility for refunds, future travel credits, vouchers, or other compensation is determined by the applicable Travel Supplier and/or travel insurance provider.

Where a refund is owed by a Travel Supplier, AWAY will provide reasonable assistance with the refund process but does not control the supplier’s procedures or processing timeline.

AWAY is not responsible for delays by Travel Suppliers, financial institutions, credit card issuers, insurance companies, or other third parties in processing refunds or credits.

Unless otherwise required by law, AWAY is not obligated to advance or independently reimburse funds owed by a Travel Supplier.

12. AIR TRAVEL

Airline schedules, routes, aircraft, flight numbers, and seat assignments are subject to change by the operating airline.

AWAY cannot guarantee seat assignments, schedule stability, aircraft type, upgrade availability, baggage allowances, or airline operational performance.

Travelers are responsible for reconfirming flight schedules and complying with applicable airline check-in, identification, baggage, and boarding requirements.

AWAY is not responsible for airline delays, cancellations, schedule changes, missed connections, denied boarding, lost or delayed baggage, or other acts or omissions of an airline.

13. CRUISE TRAVEL

Cruise reservations are subject to the applicable cruise line’s passenger or ticket contract, cancellation policies, and other terms and conditions.

Cruise lines may modify itineraries, ports of call, arrival and departure times, onboard programming, vessels, or other aspects of a sailing because of weather, operational requirements, safety concerns, governmental action, or other circumstances.

AWAY does not control such decisions and is not responsible for itinerary modifications made by a cruise line.

14. HOTELS, RESORTS AND ACCOMMODATIONS

Hotel and resort descriptions, photographs, ratings, amenities, construction information, room configurations, bedding, views, and other property information may be supplied by the property, Travel Supplier, or another third-party source.

Amenities, upgrades, early check-in, late checkout, resort or hotel credits, complimentary breakfast, and similar benefits are subject to the applicable program terms and/or availability unless expressly confirmed otherwise.

AWAY cannot guarantee discretionary upgrades, particular room locations, adjoining or connecting rooms, early check-in, late checkout, or other requests controlled by the property.

15. TOURS, TRANSFERS AND ACTIVITIES

Tours, excursions, transfers, guides, transportation services, and activities are operated by independent Travel Suppliers.

Travelers are responsible for reviewing and complying with age, height, weight, mobility, health, safety, dress, or participation requirements imposed by the operator.

Activities may be modified or canceled because of weather, safety considerations, operational circumstances, minimum participation requirements, governmental restrictions, or other factors outside AWAY’s control.

16. THIRD-PARTY TRAVEL SUPPLIERS

AWAY exercises reasonable care in recommending and arranging travel services but does not control the operations of independent Travel Suppliers.

Travel Suppliers are independent entities responsible for their own acts and omissions.

To the fullest extent permitted by applicable law, AWAY shall not be liable for injury, death, property damage, delay, inconvenience, disappointment, loss, irregularity, or other damages resulting from the acts, omissions, negligence, bankruptcy, insolvency, default, or failure of a Travel Supplier or other independent third party.

Nothing in these Terms is intended to waive or limit any right or liability that cannot legally be waived or limited.

17. EVENTS BEYOND AWAY’S CONTROL

AWAY shall not be responsible for failure, delay, interruption, cancellation, or modification of travel resulting from circumstances beyond AWAY’s reasonable control.

Such circumstances may include severe weather, hurricanes, natural disasters, fire, flood, epidemics or pandemics, acts of government, border closures, governmental advisories, war, terrorism, civil unrest, strikes, labor disputes, mechanical failures, supplier insolvency, transportation interruptions, or other events beyond AWAY’s reasonable control.

A traveler’s entitlement to refunds, credits, alternative arrangements, or other remedies following such an event will generally be governed by the applicable Travel Supplier’s terms, applicable insurance coverage, and applicable law.

18. DESTINATION CONDITIONS AND TRAVEL RISKS

Travel involves inherent risks, and conditions at destinations may change without notice.

Travelers are responsible for evaluating destination conditions and determining whether they are comfortable proceeding with travel.

AWAY recommends that U.S. travelers consult current information and advisories issued by appropriate governmental authorities, including the U.S. Department of State, Centers for Disease Control and Prevention, and Transportation Security Administration, before and during travel.

The ultimate decision whether to travel remains with the traveler.

19. TRAVELER CONDUCT

Travelers are responsible for complying with the laws, rules, regulations, policies, and behavioral requirements of destinations and Travel Suppliers.

A Travel Supplier may refuse service, remove a traveler, or terminate participation when permitted under its policies or applicable law.

AWAY is not responsible for costs or losses resulting from a traveler’s conduct or failure to comply with applicable requirements.

20. ACCURACY OF INFORMATION

AWAY makes reasonable efforts to provide accurate travel information. However, substantial information communicated by AWAY originates from Travel Suppliers, governmental authorities, and other third parties.

Travel information, schedules, amenities, pricing, entry requirements, policies, and destination conditions may change without notice.

AWAY shall not be responsible for inaccurate, incomplete, or outdated information supplied by a Travel Supplier, governmental authority, or other independent third party.

21. WEBSITE AND THIRD-PARTY CONTENT

The AWAY website may contain information, booking functionality, or links supplied or operated by third parties.

Where the website permits users to interact or transact with third parties, those third parties are responsible for their own products, services, content, terms, privacy practices, and performance.

The inclusion of third-party information or links does not constitute a guarantee or warranty by AWAY.

Use of third-party websites and services may be governed by separate terms, conditions, and privacy policies.

22. INTELLECTUAL PROPERTY

Unless otherwise stated, original content appearing on the AWAY website, including AWAY branding, text, graphics, logos, and other proprietary materials, is owned by or licensed to AWAY and may not be reproduced, distributed, modified, or commercially used without authorization.

Third-party trademarks, photographs, logos, and other proprietary materials remain the property of their respective owners.

23. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, AWAY’s responsibility is limited to the travel advisory, planning, concierge, and booking services actually performed by AWAY.

AWAY shall not be responsible for indirect, incidental, special, punitive, or consequential damages resulting from the acts or omissions of Travel Suppliers or circumstances outside AWAY’s reasonable control.

Nothing contained in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

24. INDEMNIFICATION

To the fullest extent permitted by applicable law, the client agrees to indemnify and hold AWAY harmless from claims, losses, expenses, or liabilities resulting from the client’s material breach of these Terms, violation of applicable law, provision of materially inaccurate information, or unauthorized use of AWAY’s services.

This provision does not require a client to indemnify AWAY for AWAY’s own negligence or misconduct where such indemnification would be prohibited by applicable law.

25. GOVERNING LAW AND JURISDICTION

Except where otherwise required by applicable consumer protection law, these Terms and disputes concerning services provided by AWAY shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Subject to jurisdictional or consumer rights that cannot lawfully be waived, legal proceedings involving AWAY shall be brought in a court of competent jurisdiction in the State of Florida.

26. ELECTRONIC COMMUNICATIONS

Clients consent to receiving communications relating to their travel inquiries, professional services, reservations, payments, and travel arrangements electronically, including by email and, where the client has separately provided the required consent, text message.

Electronic records, signatures, authorizations, and communications may be used in connection with the travel planning and booking relationship to the extent permitted by applicable law.

27. PRIVACY AND PERSONAL INFORMATION

In order to research, arrange, book, and manage travel, AWAY may need to collect and transmit personal information concerning travelers.

Information provided to AWAY may be shared with OASIS Travel Network, Travel Suppliers, technology providers, payment processors, insurance providers, and other parties when reasonably necessary to research, arrange, manage, or fulfill requested travel services.

The collection and use of personal information is also subject to AWAY’s applicable Privacy Policy.

28. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect to the extent permitted by applicable law.

29. CHANGES TO THESE TERMS

AWAY may update these Terms periodically to reflect changes in its services, business practices, supplier relationships, or applicable requirements.

The version applicable to a particular transaction will generally be the version in effect when the client engages AWAY or authorizes the applicable travel services, unless otherwise required by law.

30. ACCEPTANCE OF TERMS

By engaging AWAY’s services, authorizing a reservation, submitting payment authorization, making payment toward travel arrangements, or otherwise proceeding with a booking after receiving or being provided access to these Terms, the client acknowledges and agrees to these Terms.

An individual communicating with AWAY on behalf of multiple travelers represents that they are authorized to provide information and communicate regarding the reservation on behalf of those travelers and agrees to communicate applicable travel information and terms to the other travelers included in the reservation.


SMS TERMS AND CONDITIONS

The following SMS provisions are reproduced from AWAY’s existing SMS compliance terms without modification.

1- SMS Consent Communication:
The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

2- Types of SMS Communications:
If you have consented to receive text messages from AWAY. Travel, you may receive messages related to the following:
Conversational messages
Example: “Hello, thank you for contacting AWAY. Travel. We will be sure to follow up with you shortly. Reply STOP to opt out of SMS messaging at any time.”

3- Message Frequency:
Message frequency may vary depending on the type of communication. For example, you may receive up to 2 SMS messages per week related to your inquiry.
Example:
“Message frequency may vary. You may receive up to 2 SMS messages per week regarding your travel inquiry.”

4- Potential Fees for SMS Messaging:
Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.

5- Opt-In Method:
You may opt-in to receive SMS messages from AWAY. Travel in the following ways:
By submitting an online form

6- Opt-Out Method:
You can opt out of receiving SMS messages at any time. To do so, simply reply “STOP” to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list.

7- Help:
If you are experiencing any issues, you can reply with the keyword HELP. Or, you can get help directly from us at info@travelwithaway.com

Additional Options:
If you do not wish to receive SMS messages, you can choose not to check the SMS consent box on our forms.
